Abstract

ABSTRAK Nugroho, Akhmad Rais Sidiq Jati. Hukum Perdata Terhadap Jual Beli Harta Bersama Tanpa Seizin Pihak Lain (Studi Putusan Nomor 6.Pdt.G/2018/PN.Bbs). Skripsi. Tegal: Program Studi Ilmu Hukum Fakultas Hukum, Universitas Pancasakti Tegal. 2019. Harta bersama merupakan harta kekayaan yang diperoleh selama perkawinan diluar hadiah atau warisan. Berdasarkan Undang-undang Perkawinan Pasal 35 dan Pasal 36, harta yang diperoleh selama perkawinan menjadi harta benda bersama, yaitu harta yang berada di bawah penguasaan bersama suami istri, sehingga jika salah satu pihak suami istri ingin melakukan perbuatan hukum atas hartanya itu, seperti menjual harus mendapat persetujuan dari pihak lainnya. Tujuan dari penelitian ini adalah untuk: 1) mendeskripsikan tinjauan hukum terhadap jual beli harta bersama tanpa seizin pihak lain pada putusan nomor 6/Pdt.G/2018/PN/Bbs, 2) mengkaji akibat hukum jual beli harta bersama tanpa seizin pihak lain pada putusan nomor 6/Pdt.G/2018/PN/Bbs. Penelitian ini merupakan penelitian kepustakaan (library research) dengan pendekatan penelitian normatif. Sumber data yaitu berasal dari data sekunder dengan metode pengumpulan data studi kepustakaan dan studi dokumen. Analisis data dalam penelitian ini dilakukan secara secara normatif kualitatif. Hasil penelitian disimpulkan 1) Hukum jual beli harta bersama diatur dalam Pasal 36 ayat (1) Undang-Undang No. 1 Tahun 1974 tentang Perkawinan, maka salah satu pihak baik suami atau istri tidak dapat mengesampingkan ataupun meninggalkan pihak lainnya untuk melakukan perbuatan hukum berhubungan dengan harta tersebut, karena kedudukan mereka seimbang yaitu sebagai pemilik harta bersama itu. Dengan demikian jual beli harta bersama tanpa seizin pihak lain adalah tidak sah atau batal demi hukum. 2) Akibat hukum jual beli harta bersama tanpa seizin pihak lain pada putusan nomor 6/Pdt.G/2018/PN/Bbs, yaitu perbuatan sebagai penjual dan notaris/PPAT selaku Pejabat Pembuat Akta Tanah telah kurang teliti dan kurang hati-hati dalam membuat akta peralihan hak atas objek perkara merupakan perbuatan melawan hukum sehingga akta jual beli Nomor 982/2017 tertanggal 21 Desember 2017, batal demi hukum. Akibat lebih lanjut dari jual beli tersebut Sertifikat Hak Milik Nomor 02833 atas nama Tergugat II seluas ± 162 m² yang terletak di Jalan Prof. Moh. Yamin No. 50 RT.01 RW.10 Kelurahan Pasar Batang Kecamatan Brebes Kabupaten Brebes tidak mempunyai kekuatan hukum dan atau semua produk yang timbul bersumber dari dasar jual beli yang tidak sah terhadap obyek sengketa tersebut dinyatakan tidak mempunyai kekuatan hukum. Civil Law Against Buying and Selling Assets Together Without the Permission of Other Parties (Study of Decision Number 6.Pdt.G/2018/PN.Bbs). Skripsi. Tegal: Law Faculty Faculty of Law Study Program, Tegal Pancasakti University. 2019. Joint assets represent assets obtained during a marriage other than gifts or inheritance. Under the Marriage Law Article 35 and Article 36, assets obtained during marriage become joint property, that is, property that is under joint husband and wife control, so that if a husband and wife wants to take legal action on his property, such as selling, it must get approval from the other party. The purpose of this study is to: 1) describe the legal review of the sale and purchase of shared assets without the permission of other parties in decision number 6/Pdt.G/2018/PN.Bbs, 2) examine the legal consequences of the sale and purchase of shared assets without the permission of other parties on decision number 6/Pdt.G/2018/PN.Bbs. This research is a library research with a normative research approach. The data source is derived from secondary data with the method of collecting literature and document study data. Data analysis in this study was carried out in a normative qualitative manner. The results of the study concluded: 1) The law of buying and selling shared assets is regulated in Article 36 paragraph (1) of Law No. 1 of 1974 concerning Marriage, then one of the parties, both husband or wife, cannot exclude or leave the other party to carry out legal actions related to the property, because their position is balanced, namely as the owner of the joint property. Thus buying and selling shared assets without the permission of other parties is invalid or null and void by law. 2) As a result of the legal sale and purchase of joint assets without the permission of other parties in the decision number 6/Pdt.G/2018/PN.Bbs, namely the act as a seller and notary/PPAT as the Acting Officer for Land Deed has been less careful and less careful in making deed of transfer of rights to the object of the case is an act against the law so that the deed of sale and purchase number 982/2017 dated December 21, 2017, is null and void. A further consequence of the sale and purchase of the Certificate of Ownership Number 02833 on behalf of Defendant II is ± 162 m² located on Jalan Prof. Moh. Yamin No. 50 RT.01 RW.10 Pasar Batang Sub-District, Brebes Sub-District, Brebes Regency has no legal power and or all products arising from sources of illegal sale and purchase of the disputed object are declared to have no legal power.
