Abstract

ABSTRAK Diversi merupakan pengalihan penyelesaian perkara anak dari proses peradilan pidana ke proses di luar peradilan pidana. Anak yang melakukan tindak pidana tergolong ke dalam anak yang berkonflik dengan hukum berdasarkan pasal 1 angka 3 Undang Undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak. Diversi bagi pelaku anak menyediakan alternatif yang lebih baik di banding dengan prosedur resmi beracara di Pengadilan. Penelitian ini bertujuan (1) untuk mendeskripsikan pelaksanaan Diversi oleh Jaksa Penuntut Umum di Kejaksaan Negeri Kabupaten Tegal (2) untuk menemukan hambatan yang muncul dari pelaksanaan Diversi serta upaya mengatasinya. Jenis penelitian ini adalah Library Reseach, pendekatan yang di gunakan adalah Yuridis Normatif, teknik pengumpulan datanya melalui studi kepustakaan dan analisis dengan bahan hukum primer dan sekunder. Hasil penelitian ini menunjukan bahwa proses Diversi di tingkat penuntutan yang dilaksanakan oleh jaksa penuntut umum khususnya di Kejaksaan Negeri Kabupaten Tegal sudah di laksanakan berdasarkan ketentuan yang ada dalam Undang Undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak dan Peraturan Jaksa Agung Republik Indonesia nomor : PER-006/J.A/04/2015 tentang pedoman pelaksanaan Diversi pada tingkat penuntutan. Adapun hambatan selama proses Diversi antara lain kurangnya pemahaman mengenai pengertian dan tujuan di laksanakannya proses Diversi oleh keluarga pelaku maupun keluarga korban. Selain itu, hambatan berikutnya adalah upaya Diversi tidak bisa di berlakukan terhadap tindak pidana yang diancam lebih dari 7 (tujuh) tahun. Berdasarkan hasil penelitian ini diharapkan akan menjadi bahan informasi dan masukan bagi mahasiswa, akademisi, praktisi, dan semua pihak yang membutuhkan di lingkungan Fakultas Hukum Universitas Pancasakti Tegal. Kata Kunci : Anak, Tindak Pidana, Diversi ABSTRACT Diversion is a diversion of settlement of child cases from criminal justice processes to processes outside of criminal justice. Children who commit a crime are classified as children who are in conflict with the law based on article 1 number 3 of Law Number 11 of 2012 concerning the Criminal Justice System for Children. Diversity for child offenders provides a better alternative to the official court proceedings. This study aims (1) to describe the implementation of Diversi by the Public Prosecutor in the Tegal District Prosecutor's Office (2) to find obstacles that arise from the implementation of Diversi and efforts to overcome them. This type of research is the Library Reseach, the approach used is Normative Juridical, data collection techniques through literature study and analysis with primary and secondary legal materials. The results of this study indicate that the Diversion process at the prosecution level carried out by the public prosecutor, especially in the Tegal District Prosecutor's Office has been carried out based on the provisions in Law Number 11 of 2012 concerning the Criminal Justice System of Children and the Attorney General's Regulation number: PER -006 / JA / 04/2015 concerning guidelines for implementing Diversi at the prosecution level. The obstacles during the Diversi process included a lack of understanding of the meaning and purpose of the Diversi process by the perpetrators 'families and victims' families. In addition, the next obstacle is that Diversi's efforts cannot be applied to criminal offenses that are threatened for more than 7 (seven) years. Based on the results of this study are expected to be material information and input for students, academics, practitioners, and all parties in need in the Faculty of Law, University of Pancasakti Tegal.
