Abstract

ABSTRAK Salah satu peraturan yang telah mengalami perubahan menjelang berakhirnya masa tugas anggota DPR 2014-2019 adalah UU No. 1 Tahun 1974 tentang Perkawinan. Kini, perubahannya sudah dituangkan lewat UU No. 16 Tahun 2019, dan mulai berlaku sejak 15 Oktober 2019. Penelitian ini bertujuan untuk mendeskripsikan (1) upaya pencegahan perkawinan di bawah umur sesuai dengan Undang Undang Perkawinan Nomor 16 Tahun 2019, (2) kendala-kendala dalam upaya pencegahan perkawinan di bawah umur sesuai dengan Undang Undang Perkawinan Nomor 16 Tahun 2019. Jenis penelitian ini adalah penelitian kepustakaan (library research) data-data atau bahan yang diperlukan untuk menyelesaikan penelitian berasal dari kepustakaan baik berupa buku jurnal, literature, buku, laporan penelitian, dan lain sebagainya yang berkaitan dengan permasalahan. Pengumpulan data diperoleh dari bahan hukum sekunder, pendekatan bersifat normatif (legal research). Pendekatan yuridis normatif yakni pendekatan yang dilakukan dalam bentuk mencari kebenaran dengan melihat asas-asas dalam ketentuan baik masalah perundangan Hasil penelitian, banyaknya pernikahan dini disebabkan karena adanya beberapa faktor diantarannya adalah faktor ekonomi, faktor pendidikan, faktor orang tua, faktor pola pikir masyarakat, dan faktor hamil di luar nikah. Pernikahan dini menimbulkan beberapa dampak diantaranya adalah: dampak pernikahan dini secara fisik dan dampak pernikahan dini secara psikologis. Adapun dampak pernikahan dini secara fisik antara lain terdapat ekonomi rumah tangga bahwa seorang yang menikah di usia dini belum siap untuk bekerja dan membiayai atau menafkahi keluargannya dan resiko tinggi pada ibu hamil karena kehamilan di usia yang sangat muda sehingga dapat terjadinya keguguran dan cacat fisik pada ibu yang melahirkan di usia dini. Sedangkan dampak pernikahan dini secara psikologis terdapat depresi berat yang terjadi karena belum siapnya seseorang menghadapi pernikahannya, adapula konfik yang berujung perceraian karena emosi yang belum stabil mengakibatkan konflik yang berkepanjangan pada rumah tangga. Now, the changes have been poured through Law No. 16 of 2019, and came into force on 15 October 2019. This study aims to describe (1) efforts to prevent underage marriages in accordance with Marriage Law Number 16 of 2019, (2) constraints in efforts to prevent underage marriages in accordance with Marriage Law Number 16 Year 2019. This type of research is a library research (library research) data or material needed to complete the research comes from the literature either in the form of journals, literature, books, research reports, and so forth related to the problem. Data collection was obtained from secondary legal materials, a normative approach (legal research). The normative juridical approach is the approach taken in the form of finding the truth by looking at the principles in terms of good legislative issues The results of the study, the number of early marriages caused by several factors such as economic factors, educational factors, parental factors, community mindset factors, and pregnancy factors outside of marriage. Early marriages have several impacts including: physical marriages and psychological marriages. The impact of physical early marriage include the household economy that a person who is married at an early age is not ready to work and finance or support his family and high risk for pregnant women due to pregnancy at a very young age so that miscarriage and physical disability can occur in the mother who gave birth at an early age. While the psychological impact of early marriage there is severe depression that occurs because someone is not ready to face his marriage, there are conflicts that lead to divorce because emotions are not yet stable resulting in prolonged conflict in the household.
