Abstract

Setiap kendaraan bermotor yang dioperasikan di jalan harus memenuhi persyaratan teknis dan laik jalan sebagaimana dimanatkan oleh Undang-Undang No. 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan. Sebelum kendaraan angkutan umum dioperasikan di jalan harus mendapat kepastian bahwa kendaraan tersebut telah memenuhi persyaratan tersebut. Tetapi pada kenyataannya bahwa masih cukup banyak kendaraan penumpang atau kendaraan angkutan umum yang telah lulus pengujian, masih bisa memungkinkan terjadi kecelakaan. Tujuan dari penelitian ini untuk: 1) mengkaji implementasi Undang-Undang No 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan terhadap uji laik jalan kendaraan angkutan umum di Wilayah Hukum Kabupaten Brebes, 2) mengetahui hambatan implementasi Undang-Undang No 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan terhadap uji laik jalan kendaraan angkutan umum di Wilayah Hukum Kabupaten Brebes. Jenis penelitian ini adalah penelitian lapangan (field research) dengan pendekatan hukum terapan (normative empiris). Sumber data penelitian ini adalah data primer dan data sekunder. Metode pengumpulan data menggunakan dokumen, studi kepustakaan dan wawancara. Analisis data penelitian menggunakan analisis normatif kualitatif. Hasil penelitian diperoleh suatu kesimpulan bahwa: 1) Implementasi Undang-Undang No 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan terhadap uji laik jalan kendaraan angkutan umum di Wilayah Hukum Kabupaten Brebes sudah sesuai dengan ketentuan Pasal 54 ayat (3) yaitu pengujian terhadap persyaratan laik jalan untuk kendaraan angkutan umum (mobil penumpang umum dan mobil bus). Mulai 2020 uji KIR kendaraan di Kabupaten Brebes sudah mulai menggunkan smart card, pemberlakuan smart card sebagai pengganti buku uji merupakan kebijakan nasional melalui program Kementerian Perhubungan Darat (Hubdar) 2) Hambatan implementasi Undang-Undang No 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan terhadap uji laik jalan kendaraan angkutan umum di Wilayah Hukum Kabupaten Brebes, antara lain: a) Faktor Aparat (Petugas), meliputi: moral penegak hukum, keterampilan penegak hukum; b) Faktor Fasilitas/Peralatan Pendukung terbatas sebanding dengan jumlah kendaraan yang akan diuji; c) Peran Serta Masyarakat, kesadaran hukum masyarakat masih lemah atau dengan kata lain identik dengan ketidaktaatan hukum. Every motorized vehicle operated on the road must meet the technical and roadworthy requirements as mandated by Law No. 22 of 2009 concerning Road Traffic and Transportation. Before public transportation vehicles are operated on the road, they must be certain that the vehicles have fulfilled these requirements. But in reality that there are still quite a lot of passenger vehicles or public transportation vehicles that have passed the test, it can still allow accidents to occur. The purpose of this study is to: 1) examine the implementation of Law No. 22 of 2009 concerning Traffic and Road Transportation to the roadworthiness test of public transport vehicles in the Legal District of Brebes Regency, 2) find out the obstacles in implementing Law No. 22 of 2009 concerning Traffic Road Traffic and Transportation to Roadworthiness Tests of Public Transportation Vehicles in the Legal District of Brebes Regency. This type of research is field research with a normative empirical approach to law. The data source of this research is primary data and secondary data. Methods of data collection use documents, literature studies and interviews. Analysis of research data using qualitative normative analysis. The results of the study obtained a conclusion that: 1) Implementation of Law No. 22 of 2009 concerning Traffic and Road Transportation to the road worthy test of public transport vehicles in the Legal District of Brebes Regency is in accordance with the provisions of Article 54 paragraph (3), namely testing the eligibility requirements roads for public transport vehicles (public passenger cars and bus cars). Starting in 2020 KIR test of vehicles in Brebes Regency has started to use smart cards, the application of smart cards instead of test books is a national policy through the Ministry of Land Transportation (Hubdar) program 2) Obstacles to the implementation of Law No. 22/2009 concerning Traffic and Road Transportation towards road worthy test of public transport vehicles in the Legal District of Brebes Regency, among others: a) Factors of Apparatuses (Officers), including: morality of law enforcement, law enforcement skills; b) Limited Facilities/Supporting Factors in proportion to the number of vehicles to be tested; c) Community Participation, community legal awareness is still weak or in other words synonymous with legal disobedience.
