Abstract

ABSTRAK Penelitian ini bertujuan untuk membahas permasalahan mengenai bagaimana pengaturan hukum hak cipta atas penggunaan foto orang terkenal untuk tujuan komersial? dan bagaimanakah bentuk-bentuk pelanggaran hak cipta atas penggunaan foto orang terkenal pada aplikasi menulis Alternative Universe?. Metode riset yang digunakan ialah metode library research. Pengaturan hukum hak cipta atas penggunaan foto orang terkenal untuk tujuan komersial dalam Undang- Undang Hak Cipta melindungi potret yang sudah berwujud nyata merupakan salah satu objek yang dilindungi oleh Hak Cipta. Sebuah potret yang dilindungi harus memenuhi syarat agar dapat dilindungi oleh Undang-Undang Hak Cipta. Penggunaan foto untuk tujuan komersial tanpa izin pemilik hak cipta merupakan tindakan yang melawan hukum. Penggunaan foto pada alternative universe merupakan salah satu pelanggaran jika tanpa izin pemiliki. Penyelesaian masalah sengketa hak merek penggunaan foto pada aplikasi menulis Alternative Universe dapat dilakukan dengan pengadilan dan non pengadilan. Sebelum dilakukan penyelesaian masalah di pengadilan diupayakan mediasi terlebih dahulu. Bentuk- bentuk pelanggaran penggunaan foto orang terkenal yaitu digunakannya potret idol korea untuk kegiatan promosi atau komersial pada aplikasi AU tanpa izin pemilik foto. Kata Kunci : Hak Cipta, Foto, Alternative Universe ABSTRACT This study aims to discuss the problem of how the copyright law regulates the use of famous people's photos for commercial purposes? and what are the forms of copyright infringement in the use of famous people's photos in the Alternative Universe writing application? The research method used is the library research method. The regulation of copyright law on the use of famous people's photos for commercial purposes in the Copyright Law protects portraits that are already tangible as one of the objects protected by Copyright. A protected portrait must meet the requirements in order to be protected by the Copyright Law. The use of photos for commercial purposes without the permission of the copyright owner is an unlawful act. The use of photos in the alternative universe is a violation if without the owner's permission. The resolution of trademark disputes over the use of photos in the Alternative Universe writing application can be done through the courts and non-courts. Before resolving the problem in court, mediation is attempted first. Forms of violations in the use of famous people's photos are the use of Korean idol portraits for promotional or commercial activities in the AU application without the permission of the photo owner.
