Abstract

ABSTRAK Pratiwi, Rani Diana,Gugat Rekonpensi dalam Penyelesaan Perkara Perdata Jual Beli di Pengadilan Negeri Brebes (Studi Putusan Nomor 1/Pdt.G/2019/PN Bbs). Skripsi. Tegal: Program Studi Ilmu Hukum, Fakultas Hukum, Universitas Pancasakti Tegal. 2019. Gugatan rekonpensi diajukan Tergugat karena merasa belum terdapat dalam petitum gugatan mengenai kepentingan tergugat, hanya kepentingan Penggugat saja yang diutamakan. Adanya gugatan rekonpensi, supaya adanya hukum yang adil bisa diterapkan di Pengadilan dan tidak ada salah satu pihak yang dirugikan. Tujuan dari penelitian ini untuk: 1) Mendeskripsikan dasar gugat rekonpensi dalam penyelesaan perkara perdata jual beli pada putusan nomor 1/Pdt.G/2019/PN.Bbs di Pengadilan Negeri Brebes, 2) Mendeskripsikan penyelesaan perkara perdata jual beli melalui gugatan rekonpensi pada putusan nomor 1/Pdt.G/2019/PN.Bbs di Pengadilan Negeri Brebes.Penelitian ini menggunakan pendekatan normatif, jenis penelitian ini adalah deskriptif. Sumber data penelitian ini adalah data sekunder. Metode pengumpulan data menggunakan studi kepustakaan dan studi dokumen. Analisis data penelitian menggunakan analisis kualitatif dengan penalaran deduktif. Hasil penelitian dapat disimpulkan bahwa 1) Dasar gugat rekonpensi dalam penyelesaan perkara perdata jual beli pada putusan nomor 1/Pdt.G/2019/PN.Bbs di Pengadilan Negeri Brebes yaitu Pasal 1458 Jo. Pasal 1320 KUH Perdata dan Pasal 1473, 1474, 1475 KUH Perdata. Hubungan hukum antara Tergugat Rekonpensi/Penggugat Konpensi dengan Aim Walim (suami Penggugat Rekonpensi/Tergugat II Konpensi) adalah jual beli atas obyek sengketa, bukan hutang piutang/minjam meminjam uang seperti yang didalilkan Tergugat Rekonpensi/Penggugat Konpensi; 2) Penyelesaan perkara perdata jual beli melalui gugatan rekonpensi pada putusan nomor 1/Pdt.G/2019/PN.Bbs di Pengadilan Negeri Brebes dilakukan dengan pembuktian dan pertimbangan. Berdasarkan bukti-bukti dan pertimbangan hakim terbukti bahwa perjanjian jual beli telah terjadi antara pihak Penggugat dan pihak Walim (dalam hal ini suami Tergugat II) dengan terjadi kesepakatan antara para pihak tentang harga dan letak tanah yang dijual sesuai dengan Pasal 1458 KUH Perdata dan telah memenuhi syarat sahnya perjanjian yang diatur dalam Pasal 1320 KUH Perdata. Jual beli tersebut adalah sah sehingga penguasaan atas obyek sengketa oleh Penggugat Rekonpensi/selaku istri & ahli waris Aim Walim adalah sah menurut hukum dan sebagai penjual berkewajiban membantu proses peralihan hak atas tanah obyek sengketa sesuai dengan Pasal 1474 KUH Perdata. Kata Kunci:Gugat Rekonpensi, Perkara Perdata, dan Jual Beli. ===================================================================================================== ABSTRACT Pratiwi, Rani Diana, Lawsuit for Reconstruction in the Settlement of Civil Cases in the Brebes District Court (Study of Decision Number 1/Pdt.G/2019/PN Bbs). Skripsi. Tegal: Legal Studies Program, Faculty of Law, Pancasakti Tegal University. 2019. The Defendant's lawsuit was filed by the Defendant because they felt that it was not yet included in the petitum of the claim regarding the defendant's interests, only the Plaintiff's interests were prioritized. There is a lawsuit for reconciliation, so that a fair law can be applied in the Court and no one party is harmed. The purpose of this study is to: 1) Describe the basis of the reconsideration lawsuit in the settlement of the sale and purchase of civil cases through decision number 1/Pdt.G/2019/PN.Bbs in Brebes District Court, 2) Describe the completion of the civil case sale and purchase settlement in the decision number 1/Pdt.G/2019/PN. number 1/Pdt.G/2019/PN.Bbs at the Brebes District Court. This research uses a normative approach, this type of research is descriptive. The data source of this research is secondary data. The data collection method uses literature study and document study. Analysis of research data using qualitative analysis with deductive reasoning. The results of the study can be concluded that 1) The basis of the claim for reconciliation in the settlement of civil law cases in the decision number 1/Pdt.G/2019/PN.Bbs in the Brebes District Court namely Article 1458 Jo. Article 1320 Civil Code and Article 1473, 1474, 1475 Civil Code. The legal relationship between the Respondent Defendant/Plaintiff of the Conference and Aim Walim (husband of the Respondent Plaintiff/Defendant II of the Conference) is the sale and purchase of the object of the dispute, not debts/borrowed borrowing money as argued by the Defendant Defendant/Plaintiff II of the Conference; 2) Completion of a civil sale and purchase case through a lawsuit on reconciliation in the decision number 1/Pdt.G/ 2019/PN.Bbs in the Brebes District Court carried out with proof and consideration. Based on the evidence and consideration of the judge, it was proven that the sale and purchase agreement had occurred between the Plaintiff and Walim (in this case Defendant's husband II) with an agreement between the parties regarding the price and location of the land sold in accordance with Article 1458 of the Civil Code and had fulfilled requirements for the validity of the agreement provided for in Article 1320 of the Civil Code. The sale and purchase is legal so that the control over the object of the dispute by the Plaintiff's Reconstruction/as his wife & heirs Aim Walim is legal according to the law and as a seller is obliged to assist in the process of transferring the rights to the disputed land object in accordance with Article 1474 of the Civil Code.
