Abstract

This study aims to analyze the application of criminal sanctions in traffic violations and criminal sanctions in traffic violations, in the context of overcoming traffic violations and creating an orderly atmosphere in traffic in the City of Tegal. This research was conducted at the Traffic Unit (Satlantas) of Tegal City Police Station and Tegal City Court. The data obtained are primary data and secondary data through field research and library research. The data obtained were then analyzed descriptively. The results showed that the criminal sanction of a fine is the only sanction imposed by a judge in the Tegal City District Court in deciding the case of a traffic violation. The criminal sanctions are imposed in accordance with the provisions stipulated in the Act (hereinafter abbreviated to Act) No. 22 of 2009 concerning Traffic and Road Transportation and in determining the size of the amount of fines to be imposed by judges at the Tegal City District Court based on the following considerations: Types of traffic violations committed by the perpetrators, socioeconomic status of the perpetrators, consideration of the perpetrators compliant with legal or not, and information given by the defendant at trial. The application of criminal sanctions in traffic violations especially in Tegal City has not been effective in suppressing or overcoming traffic violations because traffic violations still experience an increase due to the low number of registered criminal sanctions. Penalty fines imposed on the perpetrators of traffic violations do not have a red effect on the perpetrators so that the orderly atmosphere of traffic is still difficult to realize in Tegal City
