Abstract

ABSTRAK Tanah merupakan bagian penting bagi kehidupan masyarakat. Terjadinya permasalahan pertanahan yang muncul, biasanya dalam proses penyelesaian sengketa pertanahannya hanya dilakukan dengan cara litigasi. Penelitian ini bertujuan untuk mengetahui peran Kantor Pertanahan Kota Tegal dalam Pelaksanaan Mediasi Penyelesaian Sengketa Tanah Sesuai Peraturan Menteri Agraria No. 11 Tahun 2016 dan untuk mengetahui faktor-faktor penyebab timbulnya sengketa tanah. Jenis penelitian ini merupakan penelitian normatif empiris. Pendekatan penelitian pada penelitian ini menggunakan pendekatan secara normatif dan empiris. Metode pengumpulan data menggunakan studi pustaka dan studi lapangan dan penelitian ini dianalisis secara deskriptif kualitatif. Hasil penelitian ini menunjukan kini dengan adanya Peraturan Menteri Agraria Nomor 11 tahun 2016 tentang Penyelesaian Kasus Pertanahan, maka penyelesaian sengketa dapat dilakukan dengan cara non litigasi (mediasi). Tingkat keberhasilan mediasi di Kantor Pertanahan Kota Tegal dikatakan berhasil dan sesuai dengan prosedur dalam Peraturan Menteri Agraria No. 11 Tahun 2016. The occurrence of land problems that arise, usually in the process of resolving land disputes is only done by litigation. This study aims to determine the role of the Tegal City Land Office in the Mediation of Land Dispute Settlement in accordance with Minister of Agrarian Regulation No. 11 of 2016 and to find out the factors causing land disputes. This type of research is empirical normative research. The research approach in this study uses a normative and empirical approach. The data collection method used literature and field studies and this research was analyzed descriptively qualitatively. The results of this study indicate that now with the Regulation of the Minister of Agrarian Number 11 of 2016 concerning Settlement of Land Cases, dispute resolution can be carried out by non-litigation (mediation) method. The success rate of mediation at the Tegal City Land Office is said to be successful and in accordance with the procedures in the Minister of Agrarian Regulation No. 11 of 2016.
