Abstract

ABSTRAK Kekhawatiran akan Covid 19 oleh para notaris dalam pembuatan akta. Penelitian ini bertujuan (1) Untuk Mengkaji Pelaksanaan Tugas Jabatan Notaris dalam Pembuatan Akta Sebelum dan pada saat Masa Pandemi Covid-19 (2 Untuk Mengkaji Hambatan dalam Tugas Jabatan Notaris dalam Pembuatan Akta di Masa Pandemi Covid-19. Jenis penelitian yang digunakan penulis adalah jenis penelitian yang bersifat deskriptif. Penelitian deskriptif adalah penelitian yang merupakan prosedur pemecahan masalah yang diselidiki dengan menggambarkan atau melukiskan keadaan subjek dan objek penelitian pada sekarang berdasarkan fakta yang ada. Hasil penelitian, (1) Pelaksanaan dalam Tugas Jabatan Notaris dalam Pembuatan Akta Sebelum dan dalam Masa Pandemi Covid 19 berbeda dari perbedaan tersebut terletak pada protocol kesehatan dan kehadiran penghadap berdasarkan SK Nomor 65/33-III/ PP-INI/2020 tanggal 17 Maret 2020 lalu, perihal sebagaimana dimaksud pada pokok surat, PP INI memandang perlu untuk menyampaikan hal-hal sebagai berikut: a.Pengurus Pusat Ikatan Notaris Indonesia (PP-INI) dan seluruh jajarannya menyampaikan rasa prihatin atas perkembangan masif penyebaran Covid-19 yang secara langsung mempengaruhi pelaksanaan tugas jabatan notaris dalam memberikan pelayanan kepada masyarakat.b.berkenaan dengan itu, kami menghimbau kepada semua anggota untuk mengikuti protol kesehatan yang ditetapkan oleh pemerintah dalam usaha mengatasi penyebaran Covid-19. Khususnya himbauan untuk Work From Home (WHF/bekerja dari rumah) dan melaksanakan social distancing (jaga larak). Pelaksanaan WFH tersebut bukan merupakan bentuk pelanggaran dari Pasal 17 UU 30/2004 tentang Jabatan Notaris sebagaimana telah diubah dengan UU 2/2014 terkait larangan untuk meninggalkan wilayah jabatannya lebih dari tujuh hari kerja berturut-turut tanpa alasan yang sah.c.kondisi WFH dan social distancing tersebut tentu akan membatasi pelaksanaan tugas jabatan notaris, oleh karena itu terhadap situasi tersebut dapat ditempuh beberapa alternatif antara lain sebagai berikut : Mengatur ulang jadwal penandatanganan akta dengan para penghadap, hingga kondisi memungkinkan. Merekomendasikan rekan notaris lain yang kondisinya memungkinkan untuk menjalankan jabatan. Untuk perjanjian, perbuatan, atau rapat yang menurut peraturan perundang-undangan dokumennya dapat dibuat di bawah tangah, agar dicantumkan klausula “akan dibuat/dinyatakan kembali dalam Akta Autentik segera setelah darurat Covid-19 dicabut oleh Pemerintah”.d.terkait butir tiga tersebut, agar dalam menjalankan jabatan tetap memperthatikan Undang-undang Jabatan Notaris (UUJN), kode etik, dan peraturan perundang-undangan lainnya.(2) Hambatan-hambatan dalam Tugas Jabatan Notaris dalam Pembuatan Akta Sebelum dan pada masa Pandemi Covid 19 adalah penghadap yang tidak menaati aturan pemerintah mengenai Protokol kesehatan. Berdasarkan hasil penelitian ini diharapkan akan menjadi bahan informasi dan masukan bagi mahasiswa, akademisi, praktisi, dan semua pihak yang membutuhkan di lingkungan Fakultas Hukum Universitas Pancasakti Tegal. This study aims (1) To Assess the Implementation of Duties of Notary Position in the Making of Deed Before and during the Covid-19 Pandemic Period (2 To Assess the Obstacles in the Duties of the Notary Position in Making Deed in the Covid- 19 Pandemic Period. The type of research the author uses is descriptive research. Descriptive research is research that is a problem-solving procedure that is investigated by describing or describing the state of the subject and object of research at present based on existing facts. The results of the research, (1) Implementation of the Notary's Job in Making Deeds Before and during the Covid 19 Pandemic is different from this difference lies in the health protocol and presence of parties based on Decree Number 65/33-III / PP-INI / 2020 dated March 17, 2020 Then, regarding as meant in the letter, PP INI considers it necessary to convey the following matters: a.The Central Management of the Indonesian Notary Public Association (PP-INI) and all its staff expressed their concern over the massive development of the spread of Covid-19 which directly affected carrying out the duties of a notary public in providing services to the community. b.with regard to that, we urge all members to follow the health protocol set by the government in an effort to overcome the spread of Covid-19. In particular, the appeal to Work From Home (WHF / work from home) and implement social distancing (keep larak). The implementation of the WFH is not a violation of Article 17 of Law 30/2004 concerning the Position of Notary Public as amended by Law 2/2014 regarding the prohibition to leave the area of office for more than seven consecutive working days without valid reasons.c.WFH and social conditions Such distancing will certainly limit the implementation of the duties of a notary public, therefore in this situation several alternatives can be taken, including the following: Resetting the schedule for signing deeds with the parties, until conditions allow. Recommend other notary colleagues whose conditions allow for carrying out the position. For agreements, deeds, or meetings which according to the laws and regulations the documents can be made under the hand, the clause "will be made / restated in the Authentic Deed as soon as the Covid-19 emergency is revoked by the Government".d. Related to point three, so that in carrying out his position, he must pay attention to the Notary Position Law (UUJN), code of ethics, and other laws and regulations. (2) Obstacles in the Duties of a Notary Public in Deed Making Before and during the Covid 19 Pandemic were tappers who did not comply government regulations regarding health protocols. Based on the results of this study are expected to be material information and input for students, academics, practitioners, and all parties in need in the Faculty of Law, University of Pancasakti Tegal.
