Abstract

ABSTRAK Kekayaan Intelektual merupakan suatu alat untuk meraih dan mengembangkan ekonomi, dalam arti sempit terhadap pencipta atau penemu itu sendiri, dan dalam arti luas untuk peningkatan ekonomi negara sebagai salah satu sumber devisa. Sebagai contoh salah satunya yang berpotensi untuk dikembangkan dalam era ekonomi kreatif saat ini adalah karya seni. Jenis penelitian ini bertujuan: (1) Untuk mendeskripsikan perlindungan hak cipta terhadap pencipta lagu yang karyanya di bajak orang lain tanpa ijin di media sosial. (2) Untuk mendeskripsikan penyelesaian upaya hukum yang dapat ditempuh oleh pencipta lagu apabila karyanya di bajak orang lain tanpa ijin. Jenis penelitian ini adalah penelitian kepustakaan Library Research. Penelitian jenis kepustakaan yaitu penelitian yang menggunakan data sekunder dan sumber datanya dapat diperoleh melalui penelusuran dokumen. Pendekatan yang digunakan adalah normatif. Teknis pengumpulan data melalui metode kepustakaan dan dianalisis data secara kualitatif. Hasil penelitian ini menunjukan perlindungan hak cipta terhadap pencipta lagu yang dibajak pihak lain bahwa pencipta dan pemegang hak cipta memiliki hak terhadap suatu ciptaannya, yaitu hak moral (moral right) dan hak ekonomi (economic right). Hak tersebut bersifat khusus atau istimewa, karena hanya dimiliki oleh pencipta dan pemegang hak cipta terhadap karya ciptanya. Serta upaya yang dapat ditempuh bagi pencipta lagu dalam mengatasi pembajakan dalam media sosial adalah dengan cara mendaftarkan ciptaannya tersebut kepada Direktorat Jenderal Kekayaan Intelektual. Berdasarkan hasil penelitian ini diharapkan akan menjadi bahan informasi dan masukan bagi mahasiswa, akademisi, praktisi, dan semua pihak yang membutuhkan di lingkungan Fakultas Hukum Universitas Pancasakti Tegal. For example, one of which has the potential to be developed in the current era of creative economy is art. This type of research aims: (1) To describe the copyright protection of songwriters whose works are hijacked by other people without permission on social media. (2) To describe the settlement of legal remedies that can be taken by the songwriter if his work is hijacked by someone else without permission. This type of research is library research library research. Research type of literature is research that uses secondary data and data sources can be obtained through document search. The approach used is normative. Technical data collection through library methods and analyzed data qualitatively. The results of this study indicate the protection of copyright to the songwriter who was hijacked by other parties that the creator and holder of copyright have a right to a creation, namely moral rights (economic right) and economic rights (economic right). This right is special or special, because it is only owned by the creator and copyright holder of his work. As well as efforts that can be taken for songwriters in overcoming piracy in social media is to register the work to the Directorate General of Intellectual Property. Based on the results of this study are expected to be material information and input for students, academics, practitioners, and all parties in need in the Faculty of Law, University of Pancasakti Tegal.
